Terms and Conditions

&1.
Conditions of the use of the Portal.
  1. Participation in and use of the services of the Portal by the Customer are voluntary and tantamount to acceptance of the rules set out in the Terms & Conditions. Participation is possible after registration and setting up an account on the Portal, which is tantamount to affirming consent of the Customer for acceptance of the Terms & Conditions without exceptions or reservations, consent for processing of the Customer’s personal data to the extent they were submitted to the web site in the course of registration process or in relation to using the Portal, fulfilling at the same time requirements of the Act on Protection of Personal Data of August 29, 1997 (consolidated text in the Journal of Laws of 2002, no. 101, item 926, as amended); receiving commercial information from the Portal’s partners.
  2. By sending the registration form, the User represents that:
    1. data submitted therein is complete and is in conformity with the actual state of affairs,
    2. it will pay the fee for the Service in time and under conditions set out in the Terms & Conditions, if such fee is expected,
    3. it is entitled to enter into an agreement on providing services by electronic means,
    4. data it provided do not infringe any rights of third parties,
    5. it acquainted itself with the Terms & Conditions and undertakes to comply with it,
    6. it acquainted itself and accepts rules for personal data processing and privacy policy contained in these Terms & Conditions.
  3. Using the services of the Portal is possible after submitting data and information from the Customer, as required by the Portal, and after payment of the fees for the access to specific services and after the Customer’s fulfilling conditions required by the Portal.
  4. Service Provider shall not be liable for the Client’s submission of untrue information in the course of the registration process. Information about setting up an account shall be sent to the e-mail address of the Client submitted during the registration.
  5. Sending a completed registration form by the Client is tantamount to his consent for gathering, processing and using personal data provided therein by the Service Provider and/or another data controller acting on its behalf, for statistical purposes, for the purposes of direct marketing, for transmitting commercial information by electronic communication means, in particular in compliance with the Act on Providing Services by Electronic Means of 18 July, 2002 (Journal of Laws no. 144, item 1204) and with the Act on Protection of Personal Data of August 29, 1997 (Journal of Laws no. 133, item 883); Expressing consent is voluntary. Consent may be withdrawn at any time and in any way, also after the completion of the registration. By sending the form, the Client represents that he has been informed about the right to access the content of the data and about the right to amend it.
  6. Customer’s account shall be made available for unspecified period of time and free of charge. Notices pertaining to the usage of the account will be sent to the e-mail address submitted by the Client in the registration form. The Client is solely responsible for submitting an up-to-date and correct e-mail address.

Parties’ rights and obligations
  1. Customer edits content of the postings and publishes them on the Portal on his own, using the forms available. The content of the posting, as well as the content contained therein should be compliant with the applicable legal norms, provisions of this Terms & Conditions and must not infringe the principles of good mores and personal interests of third parties.
  2. The posting can also be added for publication in the name of the Employer by an authorised LinguaJob’s employee, upon an express consent of the Employer. By the same token, the Employer represents that data he provided are true.
  3. Service Provider shall not be liable for the content of the posting and for the transmitted materials published by the Client. Service Provider reserves a right to suspend publication of a posting infringing law, good mores, reputation or interests of LinguaJob, and, in particular, postings having erotic, pornographic contents, contents with illegal software or with information on how to obtain such, and other contents contrary to the law and good mores.
  4. Providing and making available the passwords allowing to access the Portal’s resources to third parties shall not be permitted. Portal shall not be liable for the Customer’s voluntary and wilful making his data, passwords available to third parties, which may result in illegal use of the Customer’s account and in implementing unauthorised changes.
  5. Service Provider, however, has a right to perform prior checking and post-checking of the postings published by the Clients, from the perspective of its being true, accurate and compliant with law and with this Terms & Conditions.
  6. Service Provider reserves a right to modify postings and/or entries made by the Client, in particular in case the posting contains obvious errors, was assigned to an erroneous category, etc. Client further undertakes not to publish postings, which are not in line with the purpose of the Portal.
  7. Service Provider is entitled to remove the application of the Client after determining that the application is fictious, as well as when it infringes legal provisions, provisions of the Terms & Conditions or personal interests of third parties.
  8. In case of the Customer’s violation of the rules of the Terms & Conditions, generally applicable legal provisions or infringement of principles of community life, Portal can suspend or remove the Customer’s account.
  9. Service Provider reserves its right to make changes in the contents, scope, adding or deleting, temporary suspending or limiting access to certain services, without possibility to make reservations in this regard.
  10. Service Provider reserves its right to temporarily cease to provide services due to maintenance activities or activities related to modernisation of the Portal.
  11. Service Provider reserves its right to intervention in the technical structure of the Customer’s account, in order to diagnose irregularities in the functioning of the Portal’s services, and thereby to restore proper operation of the Customer’s account or of the Portal.
  12. Service provider shall make all efforts so that both the Portal and its services function continuously and without disruption. However, Service provider shall not be liable for disruptions caused by the force majeure or by illicit intervention of third parties.
  13. Service Provider shall not be liable for loss of the Portal data caused by a breakdown, dysfunction of the Internet network, loss caused as a result of illicit actions of third parties or of force majeure or of random events.

Publishing postings and using Portal’s services
  1. Customer shall have a right to publish postings on the Portal by means of the forms available on the Portal, in accordance with generally applicable law and with good mores. It is prohibited to publish within the postings or in other available parts of the web site contents, which are illegal, are inciting to discrimination on the basis of sex, race, origin or religion, profanities, obscenities, desecrations, contents infringing personal interests or substantive rights of other persons or entities, contents constituting a punishable crimes or offences against public order or infringing private rights, as well as contents offering illegal activities.
  2. Activation of a posting on the Portal occurs after 24 hours following the payment of the fee by the Client.
  3. Service Provider cannot publish two or more identical postings on the web page. The posting published can pertain to only one position.
  4. Service Provider reserves its right to moderate the content of the postings or to refuse to publish a posting without giving any reason, if the content of the posting infringes generally applicable legal provisions, Terms & Conditions or principles of community life.
  5. Publishing a posting may be dependent on paying a fee or on verification of the authenticity of the existence of the entity providing the posting carried out by the Service Provider or other entities that cooperate with it, by requiring certain documents or Benefits to be sent to the Service Provider in a form that the latter indicates.
  6. Service Provider shall have a right to verify data submitted by the Client in the course of registration and shall not be liable for the content of the postings, for its genuineness, being up-to-date, accuracy and for the existence of the provider of the posting.
  7. Service Provider shall have a right to adjust contents or a category of the posting published, after giving prior notice about the perceived irregularities, or to request it to change the content or category of the posting on his own.
  8. In case of a posting that violates rules for using the Portal, Service Provider shall have a right to remove such posting, promptly informing the Customer about it.
  9. Client shall have free of charge access to a CV DATA BASE and to a MULTILINGUAL SCORING service, while the candidates’ personal data can be used only for the purposes of recruitment in the course of employee selection within the recruitment projects for one’s principals.
  10. Proposed forms of image services (billboard, banner, button) do not constitute a roadblock and do not preclude rotating with other ads of a certain type at specified intervals.

Payment arrangements
  1. Service Provider reserves its right to make changes to payments for the Services already being rendered or to introduce new chargeable Services.
  2. Payment for the services rendered will be made and monitored through the DotPay.pl web site (here, a payment service handling the payments should be entered) to the account of the Service Provider, on the basis of the up-to-date price offer of the Service published on the Portal.
  3. After entering into Agreement and after submitting the Order, Service Provider shall issue a proforma document covering 100% of the advance payment on the remuneration for the Service, resulting from the Agreement or from the Order. Client undertakes to pay such an advance payment before accepting an order for implementation by Service Provider or before the commencement of the implementation of the Agreement by Service Provider.
  4. In case of electronic services, payments are made by the Client before his starting to use the services, by means of the electronic payments system, unless the Service provides for a form of payment on the basis of an order as mentioned above. Within a period of seven days after receipt of payment, Service Provider issues an appropriate VAT invoice.
  5. The funds paid as fees for using the services of the web page shall not be refunded, unless the basis of the request for a refund results from an exclusive fault of the Service Provider or of the entities cooperating with it.

Technical conditions
Technical requirements necessary for a proper registration and usage of the Service:
  1. personal computer connected to the Internet
  2. holding an individual e-email account; Internet browsers: Internet Explorer 5.5, or higher, Mozilla Firefox 2.0, or higher, Opera 6.0, or higher, and other compatible
  3. a browser should be accepting "cookies".

Complaint proceedings
  1. Customer shall have a right to make complaints regarding disturbances in the Portal’s functioning, problems and remarks related to the services rendered within the portal, submitted to the address: reklamacja@linguajob.pl.
  2. Properly submitted complaint should contain: data of the Service Provider, who submits the complaint (name, last name, e-mail address), subject of the complain and circumstances justifying the complaint.
  3. Submissions of the complaints shall be considered within a period of 14 days of the submission of the complaint, however in case the complaint pertains to a dysfunctions resulting from being unacquainted with the Terms & Conditions, failure to implement the directions given on a day-to-day basis within the Portal, Service Provider reserves right to leave the complaint unanswered.
  4. Service Provider reserves its right to intervention in the technical structure of the Customer’s account, in order to diagnose irregularities in the functioning of the Portal’s services, and thereby to restore proper operation of the Customer’s account or of the Portal.
  5. Any changes in the terms & conditions will be published on a Portal on an ongoing basis. Customer should promptly get acquainted with information about the changes to the terms & conditions and in case it does not accept the changes to the Terms & Conditions, Customer should stop to log in and should inform Service Provider about its decision, which shall result in a removal of the Customer's account. Each Customer’s login after introduction changes to the Terms & Conditions is tantamount to acceptance of the changes.
&7.
Final provisions
  1. Service provider shall make all efforts so that both the Portal and its Services function continuously and without disruption. However, Service provider shall not be liable for disruptions caused by the force majeure or by illicit intervention of third parties or Customers.
  2. Service Provider shall not be liable for the contents provided and published by the Clients within the Portal being authentic, true and accurate, as well as for the data and information submitted by the Clients to the Portal or to other Customers.
  3. Service provider reserves its right to temporary or partial shutting down of the Portal in order to update, improve, maintain or modify it, without a prior notice to the Customers.
  4. Service Provider shall not be liable for loss of the Portal data caused by a breakdown of the web site, dysfunction of the Internet network, loss caused as a result of illicit actions of third parties or of force majeure or random events.

Privacy policy
  1. Customers’ data are submitted only voluntarily, are being gathered and processed within the resources of the www.language-job.com Portal, and the request to remove it is tantamount to the Customer’s resignation from the use of the Portal’s resources.
  2. Service Provider ensures security of the personal data entered into and processed in connection with the usage of the Portal, thanks to the relevant measures protecting its privacy and in compliance with the Act on Protection of Personal Data of August 29, 1997 (Journal of Laws no 133.
  3. Entering own personal data by the Client is treated as expressing consent for processing thereof. At the same time, the Client shall be entitled to a right to check his data on his won, by completing, updating, modifying and removing after logging in by entering its own e-mail address and a password. In case of questions, the Client may send an e-mail to the address: pomoc@linguajob.pl. At the same time we inform, that Service Provider shall have a right to remove Client’s personal data within the meaning of the Act, without his consent and without providing justification.
  4. Personal data of the Clients can be used by the Service Provider for the purposes of implementation of the concluded agreement and for marketing purposes.
  5. For the purposes of increasing the effectiveness of the postings, Customer authorises the Service Provider to publish them in any, at the discretion of the latter, media or mass media, as long as it does not result in any costs on the part of the Customer.
  6. By entering into an agreement with the Service Provider and publishing a posting on the Portal, the Client expresses consent for processing of personal data and, in particular, for disclosing date to Service Provider for the purpose of connecting the job offers with the offers made by the potential employees.
